1. Obligations of Tuk Tuk Ceylon Rental

1.1 Vehicle Condition and Compliance

  • Vehicle is legally registered, insured, well-maintained, and roadworthy.
  • Provided with at least 4 liters of fuel at the start.

1.2 Delivery and Handover

  • Vehicle delivered 30 minutes before rental start.
  • Exact booked vehicle must be provided. All keys and accessories handed over.

1.3 Notification of Issues

Any inability to meet conditions must be communicated at least 48 hours before rental.

1.4 Assistance During Rental

  • Provide support for vehicle-related queries.
  • Assist with insurance claims or incidents.

2. Renter – Terms and Obligations

2.1 Authorized Use

  • Only the renter or authorized drivers may operate the vehicle.
  • The renter is responsible for all actions and negligence of any authorized driver.

2.2 Renter’s Obligations

  • Maintain essential fluids (oil, brake fluid, etc.) during the rental period.
  • Do not use the vehicle for illegal activities, racing, or competitions.
  • Do not exceed passenger capacity.
  • Do not drive under the influence of alcohol or drugs.
  • Do not use the vehicle if damaged or unsafe.
  • Report accidents or collisions before continuing use.
  • Replace or reimburse for lost/stolen accessories.
  • Return the vehicle clean (cleaning fee applies otherwise).
  • Pay all traffic fines, parking fees, and toll charges.

2.3 Mechanical Fault Repairs

  • Provider covers repairs for inherent mechanical faults.
  • Costs apply if faults are due to misuse or breach of terms.

2.4 Repairs by Renter

  • Repairs require prior authorization from the provider.
  • Valid receipts must be submitted for reimbursement.
  • Costs are based on a standard rate sheet or a verified mechanic’s quote.

2.5 Return Conditions

  • Return at the agreed place, date, and time.
  • Vehicle must be in the same condition (fair wear and tear accepted).
  • Fuel level must match what was provided at handover.

2.6 Late or Incorrect Return

  • Wrong location: $2/km one-way fee.
  • Late return: additional rental charges per extra hours/days.

2.7 Early Drop-Off

  • If notified 3+ days in advance: charged 2 days’ rental, balance refunded.
  • If less than 3 days’ notice: provider may charge full rental balance.

2.8 Failure to Return

  • If the renter does not return the vehicle on time:
  • The provider may report it as stolen.
  • The renter must pay ongoing rental charges and cover recovery costs.

3. Payments and Fees

3.1 General Provisions

  • Rental rates are agreed at booking and shown in USD (unless stated otherwise).
  • All payments are processed through the Website on behalf of the Provider.
  • Renter must pay all charges (including taxes, late fees) with a valid credit/debit card.
  • Payments are non-refundable once services are used.
  • The Website is not responsible for delays/errors by the payment processor.

3.2 At Start of Rental

  • Renter must pay via the Website:
  • Full rental charges.
  • Any extras or licensing fees.
  • The required security deposit.

3.3 At End of Rental

  • Renter must pay:
  • Extra or excess rental charges.
  • Third-party fees (e.g., traffic fines).
  • Replacement cost for lost/stolen accessories.
  • Any charges from breach of terms.
  • A detailed breakdown will be provided.

3.4 Authorization for Charges

Renter authorizes the Website to charge all applicable amounts to their card.

3.5 Debit Card Payments

Refunds of held amounts may take 7–10 business days.

3.6 Refunds

Any refunds will be processed within 7 days by the company.

4. Liability for Loss and Damage

  • Renter Responsibility: Liable for loss or damage to the vehicle and third-party property, unless the provider is at fault.
  • Collisions: Liability may be waived if the collision was unintended, the driver was licensed, terms were followed, and all incident details are provided.
  • Security Deposit: May be retained after damage; refunded if insurance covers the loss. Renter pays any uncovered costs.
  • Personal Injury: Provider not liable unless covered by insurance.
  • Costs Payable: Renter must cover damage from reckless use, water exposure, tire/accessory damage, or loss, plus downtime fees.
  • Calculation & Transparency: Costs limited to repair or market value. Excess payments refunded with itemized breakdowns on request.

5. Incident Reporting and Responsibilities

  • Renter/driver must:
  • Report incidents to police (if required by law).
  • Notify provider in writing as soon as possible.
  • Avoid making payments, settlements, or admissions without provider consent.
  • Allow provider/insurer to handle legal claims on renter’s behalf.
  • Cooperate in insurance claims, including providing statements, attending meetings, or appearing in court if necessary.
